The arbitrator does not have the power to take or grant by a judicial authority protective measures or interim injunctions against the BSTDB, and the user undertakes not to seek provisions of the UNCLOS Arbitration Rules. If the rules of the UNCLOS Court of Arbitration do not precede a particular situation, the arbitrator will have absolute discretion in determining the procedure to be followed and the arbitrator`s decision is final. Any arbitral award rendered by the arbitrator shall be final and binding on the parties and shall take the place of another remedy. . . .
